Terms & Conditions

Please take time to read the terms and conditions of Africa Tours Adventure Ltd’s services. By confirming a safari with Africa Tours Adventure, it is assumed that you have read and fully understood and accept the terms and conditions described below;

1. SERVICES.

a. Africa Tours Adventure Ltd provides accommodation bookings , transportation, restaurant meals, excursions, tours and other services to the clients whether direct clients or from Suppliers.

b. All detailed information in the client itineraries is given to the best of Africa Tours Adventure’s knowledge based on the latest information available by the time of travel. Africa Tours Adventure is neither liable for any modified information from third party, nor for any obvious typing errors.

c. On confirming a safari, you must inform Africa Tours Adventure of any preferences and special requests such as medical needs, dietary requirements, disabilities and any other special requirements. Africa Tours Adventure will meet the requests where possible and advise on impossibilities.

d. Full passport details (Name, number and Nationality) will be required to reserve flights and gorilla permits.

e. The safari package is subject to availability and not guaranteed until confirmed. Many lodges and hotels offered by Africa Tours Adventure have limited capacity and therefore it is essential to confirm the booking in advance for your planned safari.

f. In case you wish to make changes in your reservation, you will put it in writing and Africa Tours Adventure will make the preferred adjustment possible and confirm accordingly. Africa Tours Adventure reserves the right to put a charge on the amendment relative to the actual costs, which will be added or reduced on the total invoice.

g. Africa Tours Adventure reserves the right to change and re-adjust the tour schedule, transportation, accommodation and services indicated in the itinerary in case of any unforeseen circumstances before the safari commences. Any changes to the itinerary will be communicated to the client accordingly and agreement reached.

2. FORCE MAJEURE.
In case cancellation is due to a situation beyond our control such as war, pandemic/epidemic, government regulations, etc, there will be no refund, but we shall offer you an alternative travel period at the same standard with the one you had booked before on condition that there is availability.

3. TOUR EXECUTION.

a. The wildlife live in their natural habitat and thus Africa Tours Adventure cannot guarantee wildlife or game viewing. You must take caution when viewing the animals and carefully follow the instructions given by either the tour guide or wildlife rangers to avoid any danger.
In case of a gorilla or chimpanzee permit purchased, it will guarantee ability to track the primates in question but does not guarantee that these primates will be in plain sight.

b. Africa Tours Adventure reserves the right to substitute equivalent or superior lodges in consultation with the client. If a lodge or hotel of equivalent standard is not available it may be substituted with the next best quality lodge or hotel or a superior standard accommodation will be suggest at an extra charges where possible.

c. The vehicle used for transportation will be depend on the number of clients and the route taken as per the specifications of the chosen itinerary. Every effort is made to ensure that vehicles provided are in a roadworthy condition. However, there is no liability accepted for a puncture, breakdown, damage, during the safari or any delay as a result of the poor road conditions.

d. The guides/drivers are the key to the successful safari. Africa Tours Adventure will provide experienced English speaking driver/guides and they are the only person(s) allowed to drive Africa Tours Adventure vehicles. The driver’s decision on all matters, such as the route taken is final.

e. Africa Tours Adventure reserves the right to alter the safari route or arrangement or cancel the operation of any scheduled tour or vary the safari services in any way in the event of unforeseen circumstances, such as road closures, bad weather, problems with national parks or hotels and security considerations. In such cases, alternative arrangements will be made as circumstances permit and where possible, there will be refund of the safari deposit.

f. Africa Tours Adventure reserves the right to refuse any person from participating or continuing any tour if that person behaves in such a way as to cause or likely to cause danger, hazard or inconvenience to the other travelers, damage to property or to environments and ecosystems. No refunds will be made and Africa Tours Adventure shall not be liable for expenses incurred as a result of the termination.

4. DEPOSIT PAYMENT.

a. All tours will be confirmed as booked only upon receipt of a 30% deposit of the total price for the long safaris or 40% deposit for the short tours.
b. The balance payment will be in CASH on arrival before the tour commences or at least one week to the intended travel period by credit card of bank wire transfer.

5. CANCELLATIONS AND REFUNDS

a. All cancellation requests must be made in writing and shall be effective on the date of actual receipt by Africa Tours Adventure.

b. The following cancellation charges apply to the basic program rate:

60 days or more prior to arrival 10% charge
59 – 32 days prior to arrival 25% charge
31 – 8 days prior to arrival 50% charge
7 – 3 days prior to arrival 75% charge
48 hours to arrival 100% charge

Africa Tours Adventure reserves the right to deduct all expenses incurred from money paid.

c. Gorilla tracking permits are non refundable as it is the policy by Rwanda Development Board and Uganda Wildlife Authority.

d. No refunds will be made for any unused services, late arrival or no-show of any of the members of the tour.

6. COMPLAINTS

a. Africa Tours Adventure shall try to ensure that the company meets the expectations in every area of the tour arrangements. However, suggestions are very much appreciated in order to keep improving the quality of the service.

b. Complaints must be reported immediately to the Africa Tours Adventure’s representative and to the supplier of the service in question, who will do their best to resolve the matter. If the problem is not solved to the client’s satisfaction, the complaint should be reported in writing and not later than 30 days after completion of the tour.

c. Liability for any complaints not notified in accordance with the above described procedure cannot be accepted.

7. LIABILITY

a. Africa Tours Adventure will make every effort to ensure that all arrangements and services offered as part of the safari are carried out as specified in the most efficient way possible. However, the company does not have direct control of the provision of services by suppliers such as lodges and, whereas every supplier is chosen with the utmost care, we do not accept liability for errors or omissions of such suppliers.

b. Africa Tours Adventure shall not be liable for any loss, damage or injury of any nature whatsoever whether to person or property if it is through personal negligence.

c. Africa Tours Adventure cannot accept liability or pay compensation for unforeseen circumstances beyond the control of the company or its staff, including flight delays/cancellations or force majeure such as war or threat of war, riots, civil disturbances, terrorist acts, border closure, acts of government or other authorities, strikes, thefts, epidemics, road closures, industrial disputes, natural or nuclear disaster, extreme weather conditions, fire, technical and/or mechanical problems to transport and all similar events beyond the company’s control.

d. It is the responsibility of the traveller(s) to ensure that they have the appropriate passports, visas, travel permits, health certificates and other documentation required for the safari. Africa Tours Adventure will not take responsibility for any denial of entry into the country in case the client negligently refused to apply for the visa or take vaccination where it is required.

e. It is the responsibility of the clients to take proper medical and practical precautions in regard to health and safety. Medical advice should be sought well before travelling.

f. Clients are strongly advised to obtain comprehensive travel insurance before coming to East Africa. Local evacuation is available in the unlikely event of a medical emergency while on safari with Africa Tours Adventure.

g. The respective laws of the country govern Africa Tours Adventure’s liability to passengers carried in its own vehicles. All claims are subject to the jurisdiction of the courts of the country in which the cause of action arises.
